Alina Habba has left her position as New Jersey's top federal prosecutor. This decision was prompted by a court battle that invalidated her eligibility to hold the office.

Attorney General's Statement

US Attorney General, the Attorney General, accepted her stepping down on the start of the week. She commented that the appeals court finding made it "untenable" for the official to lead the department effectively.

"But do not mistake following the order as giving up," she wrote. "My fight will now extend throughout the country."

Court Ruling

Habba's exit follows closely on a US appeals court ruled that she had been unlawfully serving as US attorney. This ruling is could influence many legal proceedings in the state.

The court ruled that a acting appointment that did not receive Senate approval violated the statute on vacant positions.

Future Role and Reaction

The Attorney General added that she will continue working within the DOJ as a high-level advisor. Habba plans to challenge the decision of the court's action, in the hope of achieving a reversal.

In a statement, the Attorney General argued that the judiciary "must not override the executive's selection of prosecutors entrusted with executing the primary duty of the administration of criminal prosecution."

She praised the prosecutor's work and pointed out that under her leadership, the city of Newark saw a 20% reduction in crime. Additionally that the city of Camden recorded its initial homicide-free summer since 1974 with no murders.

Legal Career

Habba, was initially recruited to the former president's legal defense in 2021. She went on to represented her client in his business records case in 2024, which resulted in his guilty verdict on dozens of charges of financial record manipulation.

Earlier, Habba took on the top New Jersey post, the former president had announced he was appointing her as his senior adviser if re-elected, labeling the lawyer as a steadfast ally and a relentless legal advocate.
