Federal Court Orders Freedom of Abrego Garcia from ICE Custody

A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an error. After his return to the United States to answer human smuggling allegations, he was held in immigration custody.

In her decision, the judge pointed out that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

Background of the Legal Challenge

The court proceedings involve conflicting claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.

Conditions of Release

The court, who was hearing his petition to deportation in a federal court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
